The Supreme Court of India announced that it will hold an exclusive, full-day hearing on May 20, 2025, to address petitions challenging the newly passed Waqf Amendment Act, 2025.
A Bench led by Chief Justice of India B.R. Gavai and Justice Augustine George Masih announced on Thursday (May 15, 2025) that the Court would hear detailed arguments on May 20, 2025. The focus of the session will be to examine petitions seeking a stay on key provisions of the recently amended Act.
Addressing the counsels present, Chief Justice Gavai made it clear that the Court expects both sides to be fully prepared for an uninterrupted session. He directed all advocates to submit a consolidated note of their arguments and relevant points of law in advance to avoid any delay.
“We will not take up any other matters on Tuesday,” Chief Justice Gavai firmly told the assembled lawyers in court today.
At the outset of today’s hearing, Solicitor General Tushar Mehta, representing the government, and senior advocate Kapil Sibal, appearing on behalf of the petitioners, jointly proposed deferring the matter to next week. Both agreed that additional time would allow the Bench to thoroughly review the case records before taking up arguments on interim relief.
The matter had previously appeared before a three judge Special Bench headed by Justice Sanjiv Khanna on May 5, 2025. At that time, Justice Khanna, who was approaching retirement on May 13, 2025, expressed reservations about continuing with the case due to limited time remaining in his tenure.

As a result, the hearing was reassigned to Chief Justice Gavai’s Bench, leading to today’s decision to block a full court day for comprehensive arguments next week.
The petitions challenge several provisions of the Waqf Amendment Act, 2025, particularly concerning the identification of waqf properties, removal of ‘waqf by user’ provisions, and the inclusion of non-Muslim members in Waqf Boards and Councils. The Court is now tasked with deciding whether an interim stay is warranted while the constitutional validity of the Act is under examination.
The Supreme Court will reconvene on Tuesday, May 20, 2025, exclusively for this high-profile hearing. No other matters will be listed that day, ensuring the Bench can devote its undivided attention to this important case.
